Supporters say the approach would reward cleaner production methods and discourage companies from shifting emissions-heavy manufacturing overseas.The bill’s return comes as the European Union prepares to roll out its own Carbon Border Adjustment Mechanism (CBAM) in January 2026, a system that will require importers of carbon-intensive goods to purchase certificates reflecting the emissions embedded in their products. Sheldon Whitehouse (D., R.I.) and Rep. Suzan DelBene (D., Wash.), argue that the Clean Competition Act would create a more level playing field for American manufacturers while pushing global producers toward lower-carbon technologies.“The carbon boarder adjustment is the world’s last lifeboat to climate safety, and other nations are moving fast: the EU’s carbon border adjustment mechanism begins in January, and the UK and Australia look poised to join them. If we don’t act now, American manufacturers will have to pay fees abroad without any protection at home. The Clean Competition Act buys us entry into this emerging coalition of allies and ensures that foreign competitors who pollute more pay more,“ said Ranking Member Whitehouse.Image: Carbon BriefOverall, the United States operates with a carbon intensity that is more than 50% lower than that of its trading partners. In contrast, China’s economy is over three times more carbon intensive.Under the proposal, the federal government would calculate industry-specific emissions benchmarks and levy fees on production above those levels, regardless of whether goods are made domestically or abroad. Revenue from the program would be returned to U.S. households and manufacturers, according to sponsors, potentially softening the economic impact while maintaining the policy’s environmental incentive.Backers frame the measure as both a climate tool and an industrial policy aimed at reinforcing U.S. competitiveness in energy-intensive sectors.“The CCA is a win-win for U.S. manufacturing and the climate. Industrial facilities that produce materials such as steel and aluminum produce roughly fifteen percent of global climate emissions. The CCA would incentivize and support manufacturers both in the U.S. and abroad to reduce their industrial emissions. This helps ensure that U.S. manufacturing facilities remain competitive in a global marketplace that is increasingly prioritizing low-carbon goods,” said Mike Williams, Senior Fellow at the Center for American Progress Action Fund.A Field of Carbon Border ProposalsThe Clean Competition Act is one of several carbon border-related ideas circulating in Washington, reflecting growing bipartisan interest in linking trade and climate policy. The World Resources Institute has identified multiple congressional proposals that would impose fees or tariffs based on the emissions intensity of imported goods, though they differ sharply in structure and political rationale.Some Republican-backed bills, such as the Foreign Pollution Fee Act, emphasize penalizing imports from high-emitting countries (particularly China), while avoiding direct costs on U.S. producers. Other proposals focus more explicitly on aligning U.S. policy with international climate frameworks or responding to Europe’s CBAM.Despite the flurry of legislative activity, none of the proposals has yet cleared Congress.
